The Superior Court of Sacramento County, California, issued a ruling delaying the enforcement of certain regulations under the California Privacy Rights Act (CPRA) until March 2024.
The court issued the ruling late on June 30, granting a request put forward by the California Chamber of Commerce to impose a stay on enforcement by the California Privacy Protection Agency (CPPA) on the basis that regulations in question were issued in March 2023, only three months before the enforcement deadline.
The court found the language of the CPRA indicating a required gap of at least one year between publication of final regulations and their enforcement. Under the provisions of the CPRA, regulations were to be finalized and issued by the CPPA by July 1, 2022, with enforcement to take effect beginning July 1, 2023. The CPPA issued regulations on 12 of 15 topics discussed by the CPRA on March 29, 2023; nine months after the stipulated date.
The CPRA comprises a number of amendments to the California Consumer Privacy Act (CPPA), including more stringent obligations on data controllers and enhanced definitions. Regulations and statutory requirements implemented under the CCPA remain in full effect.
