Third-party food delivery services DoorDash and Grubhub are taking legal action against the city of San Francisco over its permanent 15% delivery fee cap, claiming it is unconstitutional and could potentially hurt restaurants.
The online food delivery companies are seeking damages and warn they may limit or completely close their operations in San Francisco. The cap was initially designed as a temporary relief measure for restaurants during the pandemic. However, earlier last month, San Francisco became the first US city to cap third-party food delivery providers permanently. The lawsuit argues that the cap could negatively impact restaurants and couriers in the form of lower order volumes, restaurant revenue, and courier earnings, as consumers could experience higher prices due to bearing the costs not covered by restaurants.
The Golden Gate Restaurant Association (GGRA) is working toward establishing laws allowing restaurants to sign additional contracts with third-party food delivery providers for marketing and additional services.
