Veriff settles class action lawsuit for USD 4 million

Regulation/policy

  • Veriff, an identity verification platform, has agreed to pay USD 4 million to settle a class action lawsuit (without admitting any wrongdoing) and filed against it under the Illinois Biometric Information Privacy Act (BIPA).

  • Veriff has allegedly failed to comply with BIPA, in relation to obtaining consent before collecting facial geometry scans for identity verification. Accordingly, Veriff has agreed to comply with BIPA by obtaining consent for data collection in the future and hopes to develop a public retention schedule.

  • Analyst QuickTake: Although relatively rare, FinTech infrastructure companies have failed to comply with privacy regulations in the past. In August 2021, Plaid agreed to pay USD 58 million in a class-action lawsuit over claims that the company used banking login credentials to share data with third-party firms without prior consent.
