Tofurky, the plant-based food brand of Turtle Island Foods, has requested the federal appeals court to annul a Missouri law pertaining to the misrepresentation of plant-based products as meat products. According to the law, misrepresenting a product as meat that is not derived from the harvested production of livestock or poultry was recognized as a crime, punishable by up to one year in prison.
The law that was passed in 2018 was challenged by Tofurky in October 2018, with a lawsuit requesting a preliminary injunction against the bill. US district judge Fernando Gaitan, Jr. denied Tofurky’s request citing that the state of Missouri would not prosecute any non-meat product label that used a qualifier along with the word “meat,” such as “vegetarian,” “plant-based,” or “cell-based,” which Tofurky’s labeling already included.
In July 2019, Tofurky sued Arkansas over the state's plant-based labeling law. The law was later halted as the court declared it was unconstitutional. Tofurky filed a lawsuit against the state of Louisiana in October 2020 over a similar misrepresentation law.
